Arizona federal court vacates Trump administration’s rewrite of WOTUS

A U.S. district court in Arizona has vacated the Trump administration’s rewrite of the Waters of the U.S. Rule. The judge says that leaving the rule in place while the Biden administration revises it, yet again, would lead to “serious environmental harm.”

This decision is a win for several Native American tribes who sued EPA and the Army Corps of Engineers, who claimed Trump’s rule failed to protect their waterways.

American Farm Bureau President Zippy Duvall says that three courts previously upheld the Navigable Waters Protection Rule. He says, “This ruling casts uncertainty over farmers and ranchers across the country and threatens the progress they’ve made to responsibly manage water and natural resources.”

Duvall says that they are reviewing the ruling to determine their next course of action.
