A federal judge has ruled H-2A protections are unconstitutional

A federal judge says a Labor Department rule aimed at protecting H-2A visa holders is unconstitutional, siding with 17 states that filed a complaint.

The judge says the Biden-Harris Administration rule gives farmworkers collective bargaining rights, and that is a right not previously granted by Congress. 17 states challenged the rule along with several Georgia ag groups.

The Southeastern Legal Foundation praised the ruling, saying it protects America’s producers from executive overreach.
